Identity Theft Laws to Know About

Identity theft is a crime that is illegal and many different identity theft laws are placed that help to punish those who take part of identity theft actions. The punishments that can be involved with identity theft can be very severe under these laws.

The main law to see in the United States is the Identity Theft Assumption and Deterrence Act. This states that a person is an identity theft if that person uses one’s identity willingly and without the permission of the person whose identity is being used to commit or assist with something that violates federal law. This can include such things as stealing money from one’s financial records or using services in another person’s name. A person who commits identity theft will break this law and can be forced to spend years in prison for the crime in most cases.

One of the most recent identity theft laws that was created is the Identity Theft Penalty Enhancement Act. This is a law in the United States that makes the use of stealing one’s identity with the intention of handling criminal activities a felony. A person who breaks this law will have to serve at least two years in prison with the penalty being even higher for any terrorist-related actions that could be handled.

Most states will work with their own different identity theft laws. In some cases identity theft will be seen in one area as a felony while in others it will be interpreted as a misdemeanor. It helps to check one’s area to see what identity theft laws are in place to see what one will be dealing with.

Don’t forget that in many cases the level of the crime will become greater in the event that the amount of money that was handled in a certain state is higher. For instance, in Connecticut identity theft that involves ten thousand or more dollars is a Class B felony while a theft with five to ten thousand dollars involved is a Class C felony that is lower in intensity but still severe. Again it will help to see what laws are used in individual states with regards to this.

These identity theft laws are great things to see with regards to one’s needs. The laws are used to help with deterring people from committing identity theft by working with strong penalties. Various laws can be found in individual states as well.
